The following are upcoming advisory circular and new final rules, effective December 9, 2008.

On December 8, 2008, the U.S. Court of Appeals for the District of Columbia Circuit issued an order staying the FAA's planned auction of limited slots at John F. Kennedy International Airport (JFK), Newark Liberty International Airport (EWR), and LaGuardia Airport (LGA). New limits on unscheduled operations at JFK and EWR, and changes to the existing LGA rules were included in the FAA's final rules. As a result, the FAA separately will address unscheduled flights at JFK and EWR in the immediate future. Pending the publication of this information, the FAA is suspending the reservation requirement for unscheduled flights at JFK and EWR until further notice. At LGA, all non-scheduled IFR arrivals and departures during controlled hours require reservations. VFR operations will be accommodated by air traffic control (ATC) when possible. ATC may advise it is not accepting VFR operations or may require reservations during certain periods.
